TIFCO Privacy Policy (California Residents/CCPA)

This California Privacy Policy describes how TIFCO ("Company," "we," or "us") collect and process personal information about our consumers who reside in California. The California Consumer Privacy Act ("CCPA") requires us to provide our California consumers with a privacy policy that contains a comprehensive description of our online and offline practices regarding our collection, use, and sharing, of personal information, along with a description of the rights they have regarding their personal information. This California Privacy Policy provides the information the CCPA requires, together with other useful information regarding our collection and use of personal information. Any terms defined in the CCPA have the same meaning when used in this policy.

This California Privacy Policy does not apply to our collection and use of personal information from residents outside of California. Consumers residing in other locations should see our general privacy policy at: tifco.com/privacy.

We collect and use information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household ("personal information"). Personal information does not include:

Sensitive Personal Information

Under the CCPA, certain types of personal information are considered "sensitive" personal information and require additional data privacy rights and obligations. TIFCO collects account login, account number, precise geolocation, and financial and other payment information (e.g., credit card information), which may be considered sensitive personal information under the CCPA. We only collect this sensitive personal information for limited purposes, such as to perform the services requested, to prevent, detect and investigate security incidents, to resist malicious, deceptive, fraudulent or illegal actions and prosecute those responsible, and for other permitted purposes ("Permitted SPI Uses"). Because TIFCO uses this sensitive personal information for Permitted Uses, there is no need for it to provide a Limit Use and Disclosure of Sensitive Personal Information right under the CCPA.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice. If required by law, we will also seek your consent before using your personal information for a new or unrelated purpose.

We may collect, process, and disclose aggregated or deidentified consumer information for any purpose, without restriction. When we collect, process, or disclose aggregated or deidentified consumer information, we will maintain and use it in deidentified form and will not attempt to reidentify the information, except to determine whether our deidentification processes satisfies any applicable legal requirements.

Disclosing, Selling, or Sharing Personal Information

We may disclose the personal information we collect to third parties for the business purposes described in the Personal Information Collection, Use, and Disclosure Purposes section and in the list below, such as to support our business functions. For example, we may disclose your address to our shipping carrier to deliver your order.

We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, prohibit using the disclosed information for any purpose except performing the contract, and meet the CCPA's other contract requirements for engaging service providers or contractors.

The Right to Request Deletion You have the right to request the deletion of personal information we have collected from you, subject to certain exceptions.
The Right to Opt Out of Personal Information Sales You have the right to direct us not to sell personal information we have collected about you to third parties now or in the future.
The Right to Non-Discrimination You have the right not to receive discriminatory treatment for exercising these rights. However, please note that if the exercise of these rights limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our products and services or engage with you in the same manner.
"Shine the Light" California residents that have an established business relationship with TIFCO have rights to know how their information is disclosed to third parties for their direct marketing purposes under California's "Shine the Light" law. (Civ. Code § 1798.83)

Verification Process and Authorized Agents

Only you, or someone legally authorized to act on your behalf, may make a Consumer Rights Request related to your personal information. The authorized agent must provide a letter signed by you confirming the agent has permission to submit a request on your behalf or must provide sufficient evidence to show that the authorized agent has been lawfully vested with power of attorney.

We cannot respond to your Consumer Rights request if we cannot verify your identity or authority to make the request and confirm the personal information relating to you. We will only use personal information provided in the request to verify the requestor's identity or authority to make the request.

Privacy Policy Changes

We reserve the right to update this California Privacy Policy at any time. If we make any material changes to this Policy, we will update the policy's effective date.
